Terms of Service

You must be at least 18 years old to use NearMi. By creating an account you confirm that you meet this requirement. We reserve the right to terminate accounts of users found to be under 18.

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate information when creating your account.
• You may not create more than one account or create an account on behalf of someone else without their consent.
• You are responsible for all activity that occurs under your account.

You agree not to:

• Harass, threaten, or harm other users
• Post or send sexually explicit content involving minors
• Impersonate any person or entity
• Use the app for commercial solicitation, spam, or pyramid schemes
• Attempt to reverse-engineer, hack, or disrupt the platform
• Share another user's location or personal information without their consent
• Use automated bots, scrapers, or scripts to interact with the platform

Violations may result in immediate account suspension or termination without refund.

You retain ownership of content you post on NearMi. By posting, you grant NearMi (SpotMi)a worldwide, non-exclusive, royalty-free licence to use, display, and distribute your content solely for the purpose of operating and improving the platform.

You are solely responsible for your content. We do not pre-screen content but reserve the right to remove any content that violates these Terms or our community guidelines.

NearMi requires location access to function. By enabling location permissions you consent to your GPS coordinates being shared with our servers and used to show your approximate position to other nearby users. You can disable location sharing at any time using Ghost Mode or by revoking location permissions in your device settings.

• Premium features require a paid subscription (KES 250/month).
• Payments are processed via M-Pesa. By initiating payment you authorise the charge to your M-Pesa account.
• Subscriptions are billed monthly and auto-renew unless cancelled.
• Refunds are not provided for partial subscription periods.
• We reserve the right to change subscription pricing with 30 days' notice.

You may delete your account at any time from within the app. We may suspend or terminate your account for violation of these Terms, harmful behaviour, or at our discretion with reasonable notice except in cases of serious violations where immediate termination is warranted.

Upon termination, your right to use NearMi ceases immediately. Your data will be deleted within 30 days as described in our Privacy Policy.

NearMi is provided "as is" without warranties of any kind. We do not guarantee that the app will be available at all times, error-free, or free of harmful components. We are not responsible for the conduct of other users on or off the platform.

NearMi is a discovery tool — we do not conduct background checks on users and make no representations about the identity or intentions of any user. Always exercise personal safety when meeting people in person.

To the maximum extent permitted by law, NearMi (SpotMi) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use ofNearMi, including but not limited to loss of data, loss of revenue, or personal injury resulting from meetings arranged through the app.

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
